Terms of Service

1. Agreement and Scope

These Terms of Service (the "Terms") are an agreement between you and Avenyx, which operates OSINTNova, BosINT, osintnova.com, app.osintnova.com, related Discord services, APIs, documentation, subscriptions, tools, features, results, and other services that link to these Terms (collectively, the "Services").

By accessing or using the Services, creating or linking an account, signing in with Discord or Google, purchasing OSINTNova Pro, using BosINT in Discord, using an API key, or otherwise interacting with the Services, you agree to these Terms. If you use the Services for a company, agency, organization, client, or other entity, you represent that you have authority to bind that entity, and "you" includes both you and that entity.

OSINTNova is a privacy-aware open-source intelligence platform for lawful research, personal online-footprint review, cybersecurity, threat intelligence, non-consumer-reporting due diligence, journalism, private investigation, law enforcement, fraud prevention, and related investigative workflows. The Services help locate, organize, analyze, enrich, or summarize information from public, user-provided, licensed, security, and other lawful sources. The Services are not a guarantee that information is complete, current, lawful for every use, or fit for a particular legal, investigative, employment, credit, housing, insurance, lending, or eligibility decision.

Some features may have additional posted terms, usage limits, checkout disclosures, Discord rules, API terms, payment processor terms, third-party service terms, or plan-specific notices. Those additional terms apply to the relevant feature. If they conflict with these Terms, the more specific terms control for that feature.

2. Eligibility and Accounts

You must be at least 18 years old and a legal adult in your jurisdiction to use the Services. The Services are not intended for minors. You may not create an account, subscribe, submit personal information, run searches, upload content, or use the Services if you are under 18 or otherwise unable to enter into these Terms.

Features that expose OSINT research results are intended to require authenticated access. We do not intentionally offer anonymous access to those features, and activity passing through systems we control is designed to be associated with an authenticated account, session, server installation, or API key so we can enforce limits, investigate misuse, and protect users and third parties. These controls reduce risk but do not guarantee that unauthorized access, credential sharing, or technical circumvention will never occur.

OSINTNova and BosINT generally use external sign-in providers such as Discord or Google. Those providers control their own credentials, authentication, security, profile records, and provider-side data. You are responsible for keeping your linked accounts secure and for all activity that occurs through your linked account, session, API key, Discord server, or payment method.

You agree to provide accurate, current, and complete information when you sign in, subscribe, request support, submit a blacklist request, report a vulnerability, or otherwise interact with us. You may not create a new identity, account, server installation, or payment path to avoid a ban, rate limit, suspension, chargeback decision, abuse review, or prior enforcement action unless we give written permission.

You are responsible for confirming that your use of the Services is lawful for your role, jurisdiction, employer, agency, client, and subject matter. If you are subject to professional, government, law enforcement, private investigator, journalist, employment, financial, education, healthcare, or regulated-industry rules, you are responsible for complying with those rules.

3. Responsible OSINT Use

OSINTNova is built for lawful, ethical open-source intelligence. You may use the Services only for a legitimate purpose and only when you have a lawful basis to run the search, submit the data, analyze the identifier, use the output, and share any information you independently preserve. The fact that information is publicly available does not permit unlawful, harmful, or abusive use.

Vetted Sources and Exposure Signals

Before making an integration generally available, we use a risk-based review process intended to assess the provider's reputation, authorization, security practices, output type, and apparent data provenance. As a matter of policy, we do not knowingly select or maintain an integration for the purpose of giving users raw data obtained through theft, a data breach or leak, unauthorized access, or other illegal means. Provider practices, representations, and data provenance can change or be incomplete, however, and we cannot independently verify every upstream fact. We may suspend, restrict, investigate, or remove an integration if we reasonably believe it creates legal, security, privacy, or abuse risk.

Exposure features are designed to return limited incident or exposure signals rather than the underlying leaked record or sensitive contents such as passwords, stolen credentials, private keys, session tokens, payment card data, Social Security numbers, identity documents, private messages, or raw breach dumps. We use reasonable technical and administrative controls intended to prevent that material from being returned through the Services, but no upstream review, automated filter, or monitoring process can guarantee that a provider will never return inaccurate, misclassified, or prohibited material. If we identify such material, we may block the result, disable the source, preserve limited evidence for security or legal purposes, and take other appropriate remedial action. Exposure signals are offered for defensive awareness and lawful investigation, not to reveal or distribute compromised data.

Publicly Available Information

Our tools may locate, crawl, index, organize, or summarize information that appears to be freely available to the public on websites, search engines, public APIs, public records, public profiles, historical archives, and similar open sources. We design the Services not to bypass authentication, access controls, paywalls, or similar technical restrictions. Any collection, display, or transformation of public-source material is limited to what we reasonably believe is permitted by applicable law, contract, license, or an applicable exception such as fair use. Public availability alone does not establish that material is free of legal restrictions or third-party rights.

Public information may include material a person published directly or allowed a website, platform, or other service to publish. We use risk-based filters and review processes intended to limit restricted sensitive data, but those controls are not infallible and public-source information may still appear in results when relevant to a lawful OSINT purpose. Public availability does not make information accurate, current, or appropriate for every use, and it does not override privacy rights, intellectual property rights, source restrictions, or applicable law.

Examples of Responsible Use

Depending on your authority, purpose, and applicable law, responsible uses may include private investigations involving missing persons; vendor, supplier, and business-partner vetting; business due diligence; authorized attack-surface mapping; threat-actor profiling; phishing-domain monitoring; dark-web credential-exposure monitoring that does not reveal credentials; fraud investigations; lawful asset, witness, or subject location; investigative journalism; brand monitoring; personal exposure audits; assisting authorized government officials or law enforcement; and similar lawful investigative, safety, and cybersecurity work.

These examples are illustrative, not automatic permission. You remain responsible for having the authority, consent, permissible purpose, and professional licenses required for your work. Even when information is public or a use resembles an example above, you may not engage in illegal conduct, harassment, stalking, intimidation, discrimination, or any other conduct prohibited by Section 4.

You may not use the Services to violate the Computer Fraud and Abuse Act, identity-theft laws, wire fraud laws, state computer crime laws, anti-stalking or harassment laws, privacy laws, consumer protection laws, the Driver's Privacy Protection Act, the Fair Credit Reporting Act, export control or sanctions rules, or any other applicable law. You also may not use the Services to violate Discord, Google, PayPal, Patreon, Cash App, blockchain network, data-source, website, platform, API, or other third-party terms that apply to your activity.

No Consumer Reporting Use

The Services are not designed, offered, or intended to be a consumer reporting service, and OSINTNova does not knowingly furnish consumer reports as those terms are defined by the Fair Credit Reporting Act ("FCRA"). OSINTNova does not verify identities, assure maximum possible accuracy, obtain consumer authorizations, provide consumer files or dispute procedures, certify permissible purposes, or perform the other functions required of a consumer reporting agency. Service output must not be treated as a consumer report or as establishing a person's identity, character, reputation, personal characteristics, mode of living, creditworthiness, or eligibility.

You may not use or provide the Services or any output, in whole or in part, as a factor in determining eligibility for credit, employment, background screening, tenant screening, housing, insurance, lending, education admission, benefits, licensing, or any other consumer purpose regulated by the FCRA or a similar federal, state, local, or international law. You may not represent that OSINTNova is FCRA compliant, that any output is a consumer report, or that we have verified a permissible purpose. You represent and warrant that neither you nor anyone acting through your account will use the Services for a prohibited consumer-reporting purpose.

Labels and contractual restrictions do not control whether a law applies to actual conduct. If we learn or reasonably suspect that the Services are being marketed, configured, resold, or used for a regulated consumer-reporting purpose, we may require additional information, restrict searches or exports, preserve relevant records, suspend or terminate access, and take other measures needed to avoid or address that use. Nothing in these Terms excludes any obligation that applies to us under the FCRA or other non-waivable law.

Vehicle and Regulated Data

If you use vehicle, license plate, phone, people, location, breach, dark web, or other sensitive investigative tools, you are solely responsible for having a permissible purpose and complying with all applicable federal and state laws, including the Driver's Privacy Protection Act where it applies.

4. Prohibited Conduct

You may not use, attempt to use, or assist another person in using the Services for any unlawful, harmful, abusive, deceptive, or unauthorized purpose. Prohibited conduct includes:

  • Doxxing, stalking, harassment, intimidation, threats, swatting, extortion, blackmail, or singling out a person for abuse
  • Searching for, sharing, selling, validating, or using stolen credentials, private keys, session tokens, payment data, Social Security numbers, identity documents, or raw breached records
  • Attempting to access any account, computer, service, API, database, device, network, wallet, or system without authorization
  • Using results to commit fraud, phishing, credential stuffing, account takeover, impersonation, identity theft, SIM swapping, financial crime, or evasion of law enforcement
  • Scraping, crawling, automating, rate-limit bypassing, reselling, mirroring, or bulk extracting the Services except through documented, authorized API use
  • Reverse engineering, decompiling, probing, or attacking the Services except as allowed under Section 9
  • Removing attribution, hiding the source of AI-generated or OSINTNova-generated output, or presenting generated analysis as verified human fact without review
  • Uploading content you do not have the right to use, including confidential employer data, client data, trade secrets, copyrighted works, private messages, intimate images, or protected personal data
  • Investigating minors, victims, private individuals, protected classes, or vulnerable people without a legitimate, lawful, and proportionate purpose
  • Using the Services for hate, discrimination, exploitation, non-consensual intimate imagery, child sexual abuse material, trafficking, weapons procurement, or other serious harm
  • Interfering with the Services, overwhelming infrastructure, bypassing quotas, abusing support, abusing blacklist or data-removal forms, or disrupting other users

We may monitor for abuse, investigate suspected violations, throttle or block activity, remove content, disable features, revoke API keys, suspend access, ban users or servers, report unlawful activity, preserve evidence, cooperate with payment processors and law enforcement, and take any action we reasonably believe is necessary to protect the Services, users, the public, third parties, or ourselves.

5. User Content, AI Output, and Results

"User Content" means prompts, queries, submitted identifiers, files, images, scripts, notes, feedback, support messages, blacklist requests, vulnerability disclosures, API requests, and other information you submit to or through the Services. You represent that you have all rights, permissions, lawful bases, consents, and authority needed to submit User Content and to allow us to process it to provide, secure, improve, and enforce the Services.

As between you and OSINTNova, you retain your rights in your User Content. You grant OSINTNova a worldwide, non-exclusive, royalty-free license to receive, process, transmit, display, reproduce, transform, and analyze User Content as needed to fulfill the active request or session and to operate, secure, support, bill for, and enforce the Services. For limited account, support, security, abuse, and administrative records described in Section 6, this license lasts only as long as reasonably necessary for the applicable purpose. This license does not authorize us to create a persistent backend history of raw lookup inputs or returned lookup results.

Subject to these Terms and third-party rights, we do not claim ownership of your lawful output generated by the Services. You are responsible for reviewing output before relying on it, preserving it, publishing it, sharing it, acting on it, or incorporating it into your own work. AI and OSINT outputs can be incomplete, outdated, wrong, duplicated, biased, misattributed, hallucinated, or based on public sources that later change or disappear.

You may not instruct the Services to generate or transform output in a way that violates intellectual property rights, confidentiality duties, privacy rights, platform terms, court orders, contracts, or law. If you publish or share AI-generated analysis, you must not misrepresent its source, certainty, authorship, or evidentiary value. You should preserve source links, timestamps, screenshots, and independent verification when accuracy matters.

Third-party content, links, websites, APIs, public records, search results, blockchain records, social media content, archived pages, dark web links, and other external material remain the responsibility of their respective owners or publishers. We do not control those sources and are not responsible for their legality, accuracy, availability, security, policies, or future changes.

6. Privacy, Transient Lookups, and Limited Service Records

OSINTNova does not offer saved reports, generated report links, shareable report pages, or a backend lookup history. Lookup inputs and returned results are available only during the active request or session unless you independently preserve them on your own device or in your own systems.

Transient Lookup Processing

Lookup inputs may include emails, phone numbers, usernames, domains, IP addresses, VINs, or similar values submitted by a user. Our backend processes the lookup input only as needed to execute the requested call and return the result during the active request or session. We do not intentionally write raw lookup inputs, returned results, or generated analysis to a persistent database, file store, object store, backend search history, or routine application log.

Returned results and generated analysis are delivered for the active request or session and are not saved by the OSINTNova backend for later retrieval. When the applicable request or session ends, that content is discarded from active service memory. Your browser, device, extensions, network, screenshots, downloads you create, or other systems under your control may retain content independently, and you are responsible for those copies.

Some calls depend on third-party APIs or data providers. We send those providers the information reasonably necessary to perform the requested lookup. Their processing, logging, retention, and security practices are governed by their own terms and policies and are outside our direct control. Our no-backend-storage statement describes OSINTNova-controlled systems and does not represent that an upstream provider, identity provider, payment processor, network operator, or user device stores nothing.

Limited Account and Operational Records

The no-storage practice above applies to lookup inputs and returned lookup content. It does not apply to the limited administrative information reasonably needed to authenticate users, apply plans and usage limits, operate subscriptions, provide support, secure the Services, investigate abuse, process blacklist requests, or comply with law. Depending on the feature, these records may include Discord or Google identifiers, display name, email address, server or role identifiers, plan status, API-key metadata, usage counters, payment status and transaction identifiers, support communications, blacklist requests, vulnerability disclosures, enforcement decisions, and limited security or connection metadata.

Operational and security records are designed not to contain raw lookup subjects or returned lookup results. We retain limited administrative records only for as long as reasonably necessary for the purpose for which they were collected, including account operation, tax and accounting requirements, fraud prevention, payment disputes, security, enforcement, and legal claims, subject to applicable law.

OSINTNova and BosINT are not designed to archive unrelated content from your Discord, Google, or other linked accounts. We use the limited profile and account signals those providers make available and that are reasonably needed for authorized sign-in and requested features. We do not intentionally place provider passwords, private keys, access tokens, payment credentials, or similar secrets into routine logs.

Security, Abuse, and One-Time Access Records

Verified abuse submissions, related enforcement decisions, and proportionate supporting metadata may be retained for safety, fraud prevention, repeat-abuse detection, security, or legal purposes. One-Time Access Plans depend on stable account or transaction identifiers, so we may retain the identifiers and transaction records reasonably needed to honor the plan and satisfy tax, accounting, fraud-prevention, dispute, or legal obligations.

Nothing in these Terms or in a removal request gives us control over the wider internet or third-party systems. Publishers, registries, blockchains, search engines, archives, API providers, identity providers, payment processors, and other third parties maintain their own records and copies.

Blacklist and Data Removal

Blacklist requests ask us to block a subject identifier from OSINTNova and BosINT search where technically and legally feasible. Website owners and organizations may submit crawl opt-out requests for sites, domains, or other hosted resources they control through the Blacklist page. A request does not prove ownership of data, guarantee removal from every tool, or erase third-party sources. We may reject incomplete, abusive, fraudulent, excessive, impossible, unverifiable, or bad-faith requests. See the Blacklist page for the current process and submission limits.

7. Subscriptions, Billing, and Access

OSINTNova Pro may be offered through monthly, yearly, One-Time Access, promotional, manual, crypto, Patreon, PayPal, Cash App, or other supported plans. Current public prices may include $7.99/month, $79.99/year, and $249.99 One-Time Access, but prices, plan names, features, quotas, payment methods, availability, promotions, and renewal options may change. The checkout screen or plan page controls the offer you accept at the time of purchase.

Before purchasing, review the price, billing interval, renewal status, included services, payment method, cancellation method, and any manual verification requirements. Monthly and yearly plans renew according to the payment processor or subscription platform you use unless canceled through that processor or platform. Cash App, cryptocurrency, and other manual payments may not renew automatically unless expressly stated at checkout.

You authorize the applicable processor, wallet, subscription platform, or payment service to charge your selected payment method for the plan you choose, including recurring charges where applicable, taxes, processing fees, currency conversion, network fees, or other amounts disclosed by that provider. You represent that you are authorized to use the payment method you provide.

Automatic Renewal and Affirmative Consent

Monthly and yearly plans are automatic-renewal subscriptions only when the checkout page or applicable payment processor clearly identifies them as recurring. Before you enroll, the checkout flow will disclose the amount or applicable price range, billing frequency, length of the renewal period, that charges will continue until cancellation, and an available cancellation method. Manual, Cash App, cryptocurrency, promotional, and One-Time Access payments do not automatically renew unless the offer you accept expressly states otherwise.

If you want automatic subscription renewals, use PayPal. PayPal will disclose the renewal terms before initiating a recurring charge. We will obtain your express informed consent to those disclosed automatic-renewal terms before a recurring charge begins. Where required by applicable law, we will provide an electronic acknowledgment that you can retain and that states the renewal terms, cancellation policy, how to cancel, and our contact information. We will maintain, or arrange for PayPal to maintain and make available to us, records reasonably sufficient to verify your consent for the period required by applicable law. You may cancel a PayPal subscription at any time by reaching out to OSINTNova support at [email protected] or by canceling your subscription directly through PayPal. If you do not want automatic renewal, use Cash App or cryptocurrency instead; those payment methods do not automatically renew.

You may cancel an online subscription through the account, payment processor, or subscription platform through which you enrolled. When required by applicable law, an online cancellation method will remain available without steps that unreasonably obstruct or delay cancellation. If the stated electronic cancellation method is unavailable, email [email protected] with the account identifier and subscription provider so we can provide reasonable assistance. Cancellation normally prevents the next renewal and takes effect at the end of the then-current paid period unless applicable law, the processor, or a specific written offer requires an earlier effective date or refund.

Access and Manual Perks

Paid access may include OSINTNova Platform Pro, BosINT Discord Bot Pro, Discord roles, API access, higher limits, priority support, and other plan-specific benefits. Some perks are automated; others may require manual review or activation and can take up to 48 hours or longer during outages, fraud review, holidays, or staffing constraints.

Refunds, Chargebacks, and Cancellations

We offer good-faith refunds to eligible subscription customers. To qualify, you must have used no commands during the payment period covered by the payment for which you are requesting a refund. An approved refund is limited to your most recent subscription payment; earlier payments and purchases other than subscriptions are not eligible under this policy.

To request a refund, you must contact us through the appropriate support channel by submitting a ticket at app.osintnova.com/support or emailing [email protected]. Except where required by law, processor rules, or a specific written offer, fees that do not meet the eligibility requirements above are non-refundable. Cancel recurring subscriptions through the payment processor or subscription platform you used. Access normally continues until the end of the paid period unless your access is terminated for violation of these Terms, fraud, chargeback abuse, payment failure, or risk review.

A chargeback or payment dispute is not a refund request. Chargeback categories generally apply to issues such as products not received, accidental purchases, or other payment disputes and may not provide a category for requesting a refund under this policy. Initiating a chargeback instead of contacting us through one of the support channels above will be treated as abuse of our system and will make the payment ineligible for a voluntary good-faith refund, except to the extent applicable law provides otherwise. Chargebacks, payment reversals, fraudulent payments, or processor disputes may also result in immediate suspension or removal of Pro access. Billing records are controlled by the processor or platform that handled the payment.

One-Time Access Plan

One-Time Access means a one-time purchase for access for as long as OSINTNova operates. It is not a guarantee that the business or service will operate indefinitely.

8. Platform Changes, Limits, and Termination

We may modify, replace, suspend, limit, throttle, discontinue, or remove any feature, plan, API, command, data source, model, result format, integration, documentation, quota, payment method, price, or service area at any time for security, legal, abuse-prevention, operational, cost, provider, licensing, accuracy, product, or business reasons.

We may update these Terms from time to time. The current version will be posted on this page with a last-updated date. Updated Terms take effect when posted unless a later date is stated. Your continued use of the Services after updated Terms take effect means you accept the updated Terms.

If you do not agree, stop using the Services and cancel any recurring subscription through your payment processor. We may suspend, restrict, disable, terminate, or refuse service to any user, Discord server, API key, session, subscription, payment method, or linked account with or without notice if continued access creates legal, security, payment, abuse, fraud, sanctions, operational, or third-party risk.

Examples

Reasons for changes or enforcement may include:

  • Terms violations, abuse, fraud, chargebacks, sanctions concerns, or law enforcement concerns
  • Third-party provider changes, source restrictions, model changes, security incidents, or infrastructure cost changes

Survival

After termination, your right to use the Services ends immediately. Sections that reasonably need to continue after termination still apply, including payment obligations, intellectual property rules, warranty disclaimers, limitations of liability, indemnification, dispute handling, and general terms.

9. Security Research and Penetration Testing

We permit good-faith vulnerability research against OSINTNova-owned websites and services, including osintnova.com and related domains, only under this section. This permission does not authorize testing of third-party services, payment processors, Discord, Google, users, customers, data sources, or systems we do not own or control.

Scope

Testing must be limited to systems we own or operate and must not be directed at third-party platforms, providers, users, or data sources.

Conduct

Research must be non-destructive and must not access, modify, delete, exfiltrate, retain, or disclose data beyond what is strictly necessary.

Report

If you discover a vulnerability, stop testing and report it promptly to [email protected] or through our Discord community.

Disclosure

Do not publicly disclose the vulnerability or share exploit details until we have had a reasonable opportunity to investigate and remediate.

Recognition

We may recognize valid reports with credit, subscriptions, or other discretionary recognition, but no bounty is promised unless a separate written bounty program applies.

10. Intellectual Property and Copyright

The Services, including software, interfaces, designs, text, logos, trademarks, documentation, workflows, prompts, models, result formats, databases, data compilations, algorithms, APIs, and other materials we provide, are owned by OSINTNova, Avenyx, or our licensors and are protected by intellectual property and other laws. We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Services as permitted by these Terms.

You may not copy, sell, resell, rent, sublicense, publish, mirror, scrape, frame, modify, reverse engineer, build a competing dataset from, or create derivative services from the Services except where expressly permitted in writing or by applicable law that cannot be waived.

DMCA and Copyright Complaints

If you believe material available through the Services infringes your copyright, send a notice to [email protected] with: your physical or electronic signature; identification of the copyrighted work; identification of the material and where it appears; your contact information; a statement that you have a good-faith belief the use is not authorized by the owner, agent, or law; and a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act for the owner.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate. Misrepresentations in a copyright notice or counter-notice may create liability.

11. Warranties, Disclaimers, and Limitation of Liability

Services Provided As Is

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. AVENYX AND ITS AFFILIATES, LICENSORS, PROVIDERS, AND REPRESENTATIVES DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, SYSTEM INTEGRATION, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

We work to keep OSINTNova useful, secure, and accurate, but we do not warrant that every tool, source, result, link, model, integration, or output will be available, complete, current, secure, error-free, or correct; that defects will be corrected; that the Services will be uninterrupted or free of harmful components; or that output will meet your needs or produce a particular investigative, legal, business, or security result.

OSINT and AI-assisted results require human review. You are responsible for checking important information before relying on it, publishing it, sharing it, or using it in an investigation, publication, business decision, legal matter, or safety-sensitive situation.

We are not responsible for third-party websites, public records, social platforms, search engines, APIs, payment processors, Discord, Google, data sources, blockchain networks, or other outside services. Their content, availability, rules, accuracy, and actions are outside our control.

Nothing in the Services is legal, financial, employment, credit, insurance, medical, or professional advice. You are responsible for deciding whether your use is lawful and appropriate for your situation.

Exclusion of Certain Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AVENYX AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, REPUTATION, USE, OR DATA; COST OF SUBSTITUTE SERVICES; OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

Aggregate Liability Cap

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF AVENYX AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, UNDER ANY THEORY OF LIABILITY, WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO AVENYX FOR THE SERVICES DURING THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE FIRST CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Non-Excludable Rights

The exclusions and cap above do not apply to liability that cannot lawfully be excluded or limited, and they do not limit liability for fraud, willful misconduct, or gross negligence to the extent such a limitation is prohibited by applicable law. Some jurisdictions do not allow certain warranty disclaimers, damage exclusions, or liability limits, so some provisions may not apply to you. In that event, our liability will be limited to the maximum extent permitted by applicable law. These allocations of risk are an essential basis of the agreement between you and Avenyx.

12. Indemnification

To the fullest extent permitted by applicable law, you will defend, indemnify, and hold harmless Avenyx and its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents from and against any third-party claim, demand, action, investigation, judgment, settlement, penalty, fine, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or relating to:

  • Your access to or use of the Services, including any search, result, disclosure, publication, decision, or other action based on Service output
  • Your User Content or your submission, processing, sharing, retention, or use of personal information or other third-party data
  • Your breach of these Terms, an applicable feature-specific term, or a representation or warranty you make to us
  • Your violation of applicable law, including privacy, data protection, intellectual property, computer misuse, consumer reporting, anti-discrimination, harassment, stalking, sanctions, or vehicle-record laws
  • Your violation of a third party's rights, contract, confidentiality obligation, platform rules, or terms of service
  • Fraud, negligence, willful misconduct, or unauthorized activity by you or anyone using your account, API key, session, Discord server installation, or credentials

Your indemnification obligation does not apply to the extent a claim is finally determined to have resulted from Avenyx's fraud, willful misconduct, or gross negligence. We will provide reasonably prompt notice of an indemnified claim when practicable. We may assume exclusive control of the defense and settlement at your expense, and you will reasonably cooperate. You may not settle a claim in a manner that admits fault by, imposes obligations on, or fails to fully release an indemnified party without our prior written consent, which will not be unreasonably withheld.

13. Questions, Governing Law, and Disputes

All questions, complaints, and disputes must be submitted through the correct support channel by emailing [email protected]. Refund requests may instead be submitted through the support-ticket channel identified in Section 7. Include your linked account identifier, the feature involved, the date of the issue, and what you want us to review. We will make a reasonable effort to investigate and respond.

Except for refund requests submitted under Section 7, tickets made available through OSINTNova platforms are strictly for authenticated OSINTNova users seeking help with their use of the Services. Tickets are not an accepted channel for general questions, complaints, legal notices, or disputes. Joining, messaging, or posting in any OSINTNova or BosINT platform, server, social account, or community does not create a support request and is not a valid way to submit a question or dispute. You must email [email protected] instead.

Most issues should be handled through support, the relevant payment processor, or the platform where the issue happened. For example, PayPal, Patreon, Cash App, Discord, Google, and blockchain networks each control their own accounts, payments, disputes, and records.

Informal Resolution

Before filing a lawsuit, the party raising a dispute must send the other party a written notice describing the dispute, the relevant account or transaction, the requested relief, and supporting information, and allow at least 30 days for a good-faith effort to resolve it. This requirement does not prevent either party from seeking urgent injunctive or equitable relief, filing an eligible small-claims action, preserving a claim before a limitation period expires, or using a payment processor's dispute procedure.

Governing Law

These Terms and any dispute arising out of or relating to the Services or these Terms are governed by the laws of the United States and applicable state law, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, this choice of law does not deprive you of protections that the law of your residence does not permit you to waive.

Exclusive Forum

Except for an eligible individual action in small-claims court or a request for urgent injunctive or equitable relief, you and Avenyx agree that any dispute must be brought exclusively in the federal or state courts located in the United States that have competent jurisdiction over the dispute. Each party consents to the personal jurisdiction and venue of those courts and waives objections based on inconvenient forum. If you are a consumer, this paragraph does not deprive you of any forum or protection that applicable law does not permit you to waive.

14. General Terms

Export, Sanctions, and Restricted Parties

You may not use, export, re-export, transfer, or provide access to the Services in violation of U.S. export controls, sanctions, embargoes, or restricted-party rules. You represent that you are not located in, organized under the laws of, ordinarily resident in, or acting on behalf of a sanctioned jurisdiction or restricted party where access would be prohibited.

Third-Party Services

The Services may depend on third-party platforms, APIs, models, payment processors, hosting providers, data sources, blockchains, Discord, Google, PayPal, Patreon, Cash App, and other services. We are not responsible for third-party availability, terms, moderation, billing decisions, outages, errors, data, or actions.

Assignment and Severability

You may not assign these Terms or your access without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, asset sale, financing, change of control, or transfer of the Services. If any provision is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Events Outside Our Control

We will not be liable for a delay, interruption, or failure caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, power or internet failures, cyberattacks, provider outages, government action, sanctions, epidemics, or failures of third-party platforms, networks, data sources, or payment processors.

Relationship and Third-Party Beneficiaries

These Terms do not create a partnership, joint venture, franchise, employment, fiduciary, or agency relationship between you and Avenyx. Except for the Avenyx parties expressly protected by Sections 11 and 12, there are no third-party beneficiaries of these Terms.

No Waiver and Entire Agreement

Our failure to enforce a provision is not a waiver. These Terms, together with any feature-specific terms and checkout disclosures, are the entire agreement between you and OSINTNova regarding the Services and replace prior or inconsistent understandings about the Services.
